2. Definition (Terminology used)

In these Terms and Conditions:

"Website" means Our website at www.al-ikhsan.com

"Goods" means the goods which We will supply to You in accordance with these Terms and Conditions.

"Order" means an order which You place with Us detailing the Goods You wish to buy from Us.

"We/Us/Our" means al-Ikhsan Sports Sdn. Bhd (Co. No 415771-P) having our business address at Level 2, GLO Damansara, No. 699 Jalan Damansara, Taman Tun Dr. Ismail, 60000 Kuala Lumpur, Malaysia.

"You/Your" means you, the person using Our Website and/or buying Goods from Us.

• The copyright and other ownership rights (known as "Intellectual Property Rights") in this Website and its contents (including design, text, logos, trade names, graphics, software and any other material) are owned by Us or Our licensors. You must not yourself or allow anyone else to publish, copy, distribute or modify any of the content of this Website. Anyone may view this Website and print pages from it for personal use only, for browsing Our products and placing an Order with Us. Any other use is strictly prohibited without Our prior written consent. You must not make any copy of any material from the Website for any business related use whatsoever.
• You must not in any way copy, reproduce or use any trademarks, logos or brand names which appear on the Website. Linking to Our Website on other websites is at Our discretion and We may require that You stop providing links to Our Website at any time.
• We may use any information which you upload to Our Website as We decide and We may also disclose that information to a third party.
• www.al-ikhsan.com reserves the right to change this agreement at any time with its terms effective immediately as they are posted on the site.

To place an Order with al-ikhsan, you must be over eighteen (18) years of age. If you are under eighteen (18), you may place an Order with al-ikhsan only with involvement of a parent or guardian.

6.1. Price

• Whilst we make best efforts to ensure that all details, descriptions and prices which appear on this Site are accurate, there may be instances where errors may occur. If we discover an error in the price of any Products which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled. If you cancel your Order before we have shipped it to you, and you have already paid for your Order, you will receive a full refund.
• Where applicable, prices are inclusive of GST and are in Malaysian ringgit. Delivery costs will be charged in addition where applicable; such additional charges are clearly displayed and included in the ‘Final Total’.
• We are under no obligation to fulfil your Order if the price listed on the website is incorrect (even after your Order has been acknowledged by us).

6.2. Limitation of liability

• al-Ikhsan’s total liability herein in respect of each event or series of connected events shall not exceed the total price paid for the purchase of Products and/or services under these Terms & Conditions.
• al-Ikhsan shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase of the Products, even if al-Ikhsan has been advised of their possibility.
• Any service response or delivery times stated by al-Ikhsan in the service contracts are approximate only and al-Ikhsan shall not be liable for any direct or indirect loss or damage arising from its failure to meet such response or delivery times, howsoever occasioned.
• Any typographical, clerical or other error or omission in sales literature, quotation, price list, acceptance of offer, invoice or other documents or information issued by al-Ikhsan shall be subject to correction without any liability on the part of al-Ikhsan.
• This Website and all information, content, materials, software and Products included on or otherwise made available to you through this Website are provided on an "as is" and "as available" basis, unless otherwise specified in writing.
• al-Ikhsan makes no representations or warranties of any kind, express or implied, as to the operation of this Website or the information, content, materials, software and Products included on or otherwise made available to you through this Website, unless otherwise specified in writing. You expressly agree that your use of this Website is at your sole risk.
• al-Ikhsan does not warrant that this Website; information, content, materials, software or Products included on or otherwise made available to you through this Website; their servers; or e-mail sent from al-Ikhsan are free of viruses or other harmful components.
• To the full extent permissible by applicable law, al-Ikhsan disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
• al-Ikhsan shall not be liable for any damages of any kind arising from the use of this Website or from any information, content, materials, software or Products included on or otherwise made available to you through this Website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.
• Parties other than al-Ikhsan offer services or sell products on this Website. al-Ikhsan is not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals. al-Ikhsan does not assume any responsibility or liability for the actions, products, and content of all these and any other third parties.
• al-Ikhsan does not provide any warranty for the Products. Any warranty in relation to the Products, if provided, shall be from the manufacturer. For Products shipped internationally, please note that any manufacturer warranty may not be valid; manufacturer service options may not be available; Product manuals, instructions and safety warnings may not be in destination country languages; the Products (and accompanying material) may not be designed in accordance with destination country standards, specifications, and labelling requirements. The Customer is responsible for assuring that the Product(s) can be lawfully imported into the destination country.

6.3. General

• The Customer shall not assign or otherwise transfer any Contracts or any of its rights and obligations hereunder whether in whole or in part without the prior written consent of Al-Ikhsan. Any such unauthorized assignment shall be deemed null and void.
• If any provision of these Terms & Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms & Conditions and the remainder of the provisions in question shall not be affected thereby.
• You agree to fully indemnify Al-Ikhsan, its employees, agents and suppliers, immediately on demand, from and against all claims, liability, damages, losses, costs and expenses arising out of any breach by you of these Terms & Conditions or by your use of this Website, or the use of any other person accessing this Website using your account or your personal Information.
• You agree to fully indemnify Al-Ikhsan and keep Al-Ikhsan fully and effectively indemnified against any loss of or damage to any property or injury to or death of any persons caused by any negligent act or omission or wilful misconduct by you or by any breach of the contractual obligations arising out of these Terms & Conditions.

6.4. Indemnity

• You agree to fully indemnify Al-Ikhsan, its employees, agents and suppliers, immediately on demand, from and against all claims, liability, damages, losses, costs and expenses arising out of any breach by you of these Terms & Conditions or by your use of this Website, or the use of any other person accessing this Website using your account or your personal Information.
• You agree to fully indemnify Al-Ikhsan and keep Al-Ikhsan fully and effectively indemnified against any loss of or damage to any property or injury to or death of any persons caused by any negligent act or omission or wilful misconduct by you or by any breach of the contractual obligations arising out of these Terms & Conditions.

6.5. Governing Law

• These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia and shall be subject to the exclusive jurisdiction of the courts of Malaysia.
